Accounts

Software License

Some of our Services include downloadable software which may update automatically on your device. We give you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use the software provided to you as part of the Services. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by Andabata Software, in the manner permitted by these Terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANDABATA SOFTWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Services
  • Any conduct or content of any third party on the Services
  • Any content obtained from the Services
  • Unauthorized access, use, or alteration of your transmissions or content

In no event shall our aggregate liability for all claims relating to the Services exceed one hundred U.S. dollars ($100.00).

You agree to indemnify, defend, and hold harmless Andabata Software and its officers, directors, employees, agents, and representatives from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to your use of the Services or any violation of these Terms.

8. Governing Law

These Terms shall be governed by the laws of the state of California, without respect to its conflict of laws principles. The exclusive jurisdiction and venue for any claims arising out of or related to these Terms or your use of the Services will be the state and federal courts located in San Francisco County, California.

If we make material changes to these Terms, we will provide notice through our Services or by other means to provide you with the opportunity to review the changes before they become effective.
